Waste or residues that may be used as fertilisers, that may be used in the production of fertilisers or that may be used in the co-fermentation of livestock manure.

Regulation of the Minister of Agriculture, Fisheries, Food Security and Nature amending the Fertilisers Act Implementation Regulation in connection with the amendment and addition of some residues in Annex Aa

The amendments to Annex Aa of the Fertilisers Act Implementing Regulation contained in this amending regulation may contain technical regulations.

In principle, fertilisers must not consist of or be produced from waste or residues.
This requirement is included in the Fertilisers Act to prevent all kinds of residues and wastes from being used as fertilisers in agriculture. This poses a potential risk to humans, animals and the environment because some of the mainly inorganic waste streams contain undesirable contaminants. Residues and wastes that are not subject to environmental and agricultural objections may be used if they have been designated by the Minister of Agriculture, Fisheries, Food Security and Nature and included in Annex Aa to the Fertilisers Act Implementing Regulation. This involves checking whether the wastes and residues comply with the requirements set out in the Fertilisers Act Implementing Decree and the Fertilisers Act Implementing Regulation.
With the proposed amendment to the Fertilisers Act Implementation Regulation, the Minister of LVVN designates a number of waste or residues that may be used as fertilisers in agricultural practice or may be used in the production of fertilisers. In addition, a number of wastes and residues are also designated that may be used as a secondary component in the co-fermentation of animal manure.
Finally, the definition of some of the wastes and residues referred to in the scheme has been adapted or clarified.
A mutual recognition provision has not been included, as wastes and residues originating in other Member States and complying with the designation in Annex Aa may also be used.
