Draft act amending the act on a sober upbringing and counteracting alcoholism
The draft provides for an amendment to art. 13 of the Act of 26 October 1982 on sobriety education and counteracting alcoholism (art. 1(4) of the draft) by specifying that alcoholic beverages shall be delivered to points of sale in closed containers bearing not only the name of the producer, the type and quantity of the beverage and its strength, but also information on the harmful effects of alcohol consumption by pregnant or breastfeeding women. In addition, it is proposed that the minister responsible for health should determine, by means of a regulation, the size, scope, format and manner of providing information on the harmful effects of alcohol on pregnant or breastfeeding women. At the same time, the Minister will be obliged to ensure that the information is visible, understandable and unambiguous.
The draft also provides for an amendment to art. 13(1) of the Act of 26 October 1982 on upbringing in sobriety and counteracting alcoholism (art. 1(5) of the draft) by supplementing the list of conditions on which the possibility of advertising and promoting beer depends. Advertising and promotion of beer will also have to include information about the harmful effects of alcohol consumption by pregnant or breastfeeding women. Details of the implementation of the information obligation will be laid down in a regulation of the minister responsible for health.
